This End User License Agreement (“EULA”) is a legal agreement between you (“User”) and Fragmenta (“Licensor”, “we”, or “us”) for the use of the Fragmenta iOS application (“App”). By downloading, installing, or using the App, you agree to be bound by the terms of this EULA. If you do not agree, do not download or use the App.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, strictly in accordance with this EULA and Apple’s Usage Rules set forth in the App Store Terms of Service.

2. License Restrictions

You agree not to:

Copy, modify, or distribute the App or its content.
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
Rent, lease, lend, sell, sublicense, or otherwise transfer the App or any rights therein.
Remove, alter, or obscure any proprietary notices on the App.
Use the App in any way that violates applicable laws or regulations.

3. Intellectual Property

The App and all content within it — including but not limited to text, editorial selections, design, illustrations, and software code — are owned by the Licensor or its licensors and are protected by copyright, trademark, and other intellectual property laws. This EULA does not grant you any ownership rights in the App. Classical artwork images used in the App are sourced from the Metropolitan Museum of Art Open Access collection under Creative Commons Zero (CC0) public domain designation.

4. Subscriptions and In-App Purchases

The App offers optional Premium subscriptions (monthly at $0.99/month, yearly at $8.99/year) and a lifetime purchase at $24.99. All payments are processed by Apple through the App Store.

Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

Free Trials: If a free trial is offered, any unused portion of the trial will be forfeited when you purchase a subscription. Free trial eligibility is determined by Apple and may be limited to one trial per Apple ID.

Managing Subscriptions: You can manage or cancel subscriptions at any time through your Apple ID account settings in the App Store or Settings app on your device.

5. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Content should not be relied upon as a definitive academic source. We make no representations or warranties regarding the completeness or accuracy of any historical information presented.

8. Third-Party Terms

Your use of the App is also subject to Apple’s terms and policies, including the Apple Media Services Terms and Conditions. In the event of a conflict between this EULA and Apple’s terms, Apple’s terms shall govern to the extent required.

9. Apple as Third-Party Beneficiary

You acknowledge and agree that Apple, Inc. is a third-party beneficiary of this EULA and that, upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

10. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices. Termination does not entitle you to a refund of any amounts paid.

11. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which the Licensor operates, without regard to conflict of law principles.

12. Changes to This EULA

We reserve the right to modify this EULA at any time. Changes will be reflected in the “Last updated” date above and will be made available within the App and on this page. Your continued use of the App after any changes constitutes acceptance of the revised EULA.
